FAIR USE POLICY

I. OPERATING REGULATIONS

These Operating Regulations (hereinafter "Regulations") define the terms and procedures for the use of the Sync Signal application. The aim of the Regulations is to clearly describe the way in which the application's services operate, the requirements for account creation and management, the settings associated with SOS functions, as well as the obligations of users. These Regulations constitute a supplement to the Terms of Use and the Safe Use Policy and apply to all users of the application. Understanding and complying with these Regulations is necessary for the smooth and safe operation of the Sync Signal application, as well as for the protection of users and their personal data.

A. User Account

1. To use the Sync Signal application, the creation of a user account is required. Upon registration, the user provides:

  • full name,
  • mobile phone number,
  • email,
  • age,
  • gender (male/female/non-binary/other/prefer not to answer),
  • password.

2. Upon registration, the user:

  • provides true, complete, and accurate information,
  • declares that they are over 15 years of age,
  • accepts the Terms of Use, the Fair Use Policy, and the Privacy Policy.

3. Sync Signal may ask the user to verify their email and/or phone number. Access to certain functions (such as the Panic Button or SOS notifications) may require identity confirmation via SMS or email.

4. The user is obliged to keep their account details fully updated, especially their email and mobile phone number. Sync Signal bears no liability for failure of notifications or functions when due to incorrect or outdated information.

B. Account Deletion

1. The user may discontinue using the application and delete their account at any time through the Sync Signal settings. Upon deletion, all account data is terminated and managed in accordance with Sync Signal's Data Retention and Destruction Policy.

2. Sync Signal may suspend or terminate the user's access to the application if:

  • there is a violation of the Terms of Use or the Fair Use Policy,
  • false or misleading provision of information upon registration is found,
  • abuse of the SOS function or other harmful use is detected,
  • required by law, a judicial or administrative authority,
  • there is a reason of system or user security. Where feasible, the user is informed before or immediately after the implementation of the termination.

3. Upon deletion:

  • The user loses access to the application's functions.
  • Data is deleted or anonymized in accordance with the Privacy Policy and the Data Retention and Destruction Policy.

4. Terms that by their nature remain in force continue to apply even after termination.

C. Emergency Contacts

1. Emergency contacts must have an account on the application. The user can define up to two emergency contacts, who must explicitly accept the invitation through the application in order to receive SOS notifications.

2. In case of activation of the Panic Button, emergency contacts receive the user's location, image, and audio in real-time. This sharing takes place exclusively for purposes of protecting life and physical integrity.

3. Emergency contacts must use the data they receive only for the provision of assistance and never for purposes of surveillance, intimidation, or any other impermissible behavior. Sync Signal bears no liability for misuse of data by contacts.

4. The user can add, remove, or replace emergency contacts at any time through the application settings. Contacts that are removed cease to receive SOS notifications.

5. Any emergency contact may withdraw their acceptance at any time through the application or via a relevant link provided in the invitation. Upon withdrawal, the contact is deleted from the user's emergency contact list.

6. Sync Signal does not guarantee that emergency contacts will always be available, that they will respond, or that mobile/data networks will operate uninterruptedly.

7. The service is provided as a supportive safety mechanism and does not substitute official emergency services (e.g., 112, 911).

D. Notification of Nearby Users

1. Sync Signal informs, in case of SOS activation, users located within a radius of up to 1 kilometer that there is a danger incident in the area. This function is activated exclusively for information and prevention purposes, without any obligation of reaction by nearby users.

2. Nearby users receive only basic information:

  • the exact location of the incident, and
  • the declared gender of the user (if selected) who activated the SOS. Images, audio, name, account details, or any other personal data are not shared.

3. Users receiving a notification must:

  • not use it for aggressive, intrusive, or harmful behavior,
  • not approach dangerous areas without reason,
  • not use the information for identification or tracking of another user. The application neither urges nor requires any action from the notified user.

4. Sync Signal does not guarantee that all notifications will be delivered, as there may be delays or failures due to technical network limitations, GPS, or push notification providers. The function does not substitute calling 112 or other official emergency services.

II. SAFE USE POLICY

This Safe Use Policy defines the set of rules and restrictions governing the use of the Sync Signal application, with the aim of preventing abusive behaviors and protecting the personal safety of users. This policy specifies the obligations of users when using SOS functions, notifications of nearby users, and other tools of the application, ensuring that these functions are used responsibly, legally, and with respect towards third parties. The Safe Use Policy operates supplementarily to the Terms of Use and the Operating Regulations of the application and aims at creating a safe and reliable environment for all Sync Signal users.

A. Proper use of the SOS function

1. The user is obliged to activate the Panic Button only in real or reasonable situations of danger. The intentional sending of false or misleading distress signals, as well as the abuse of the function, are prohibited and may lead to suspension or deletion of the account.

2. Notifications to nearby users are intended exclusively for informing individuals in case of potential danger. The user is not allowed to use them in a way that may create confusion, harassment, or cause distress without real cause.

B. Prohibited behaviors

1. The application is not allowed to be used for harassment, stalking, surveillance of third parties, or any form of aggressive, abusive, or illegal behavior.

2. Any use of the application is prohibited which:

  • violates legislation, moral ethics, or the rights of third parties,
  • aims at harassment, intimidation, surveillance, or circumvention of another person's privacy,
  • is used as a tool for monitoring, controlling, or coercing other persons, including family members, partners, or acquaintances,
  • uses the application with the intent of causing panic, confusion, or a false impression of danger,
  • abuses SOS functions or notifications to other users,
  • aims at unauthorized access to third-party data. Any such behavior constitutes a serious violation of the Terms and may lead, at Sync Signal's absolute discretion, to suspension or deletion of the user's account.

3. The user is not allowed, in any way, to use the application for monitoring, recording, or collecting third-party data without their consent, as provided by personal data protection legislation.

4. The application is not allowed to be used as a tool for monitoring, controlling, or coercing other persons, including family members, partners, or acquaintances.

C. Company actions in case of violation: In case of violation of the obligations defined in this policy, the company may proceed to:

  • warning the user,

  • restriction of functions,

  • temporary suspension or permanent deletion of an account.

    In serious cases, the competent authorities may be informed.

    D. Obligation to report abuse: Users are encouraged to immediately report to the company any incident they consider constitutes misuse of the application or violation of the terms. Reports can be made via support email or through the relevant function in the application.
